Fact:
Over 1 million dollars a month have left American Bandwidth Providers 
to go overseas.  This is the result of what has become excessive SBL & 
XBL listing?s against American Companies by a UK organization called, 
?Spamhaus?.


Fact:
There is NO due process for a Spamhaus listing.  A Company is proven 
guilty until an ?anonymous? Spamhaus official has deemed the listing 
worthy of removal.


Fact:
An unjustified SBL/XBL listing can cause a US Internet Company to 
immediately lose their e-mail abilities and even have bandwidth supply 
cut off.   This can cause a Company relying on their bandwidth to 
literately be put out of business.  Innocent people can lose their jobs 
all because of the NON-American, self-elected policing of Spamhaus 
representatives.


Fact:
The American Government has set forth a strict and fair set of Laws to 
abide by called the CAN-SPAM Act of 2003.  American Internet Companies 
that engage in e-mail are NOT accountable to any other set of 
guidelines.

Spamhaus has openly called the ?CAN-SPAM Act of 2003 a serious failure 
of the United States government? and Spamhaus has made it clear that 
they will NOT support the act and they in fact will fight it. **

Fact:
An American Company can be 100% CAN-SPAM compliant, but still be 
subject to the unjustified consequences of SBL/XBL listings by a 
NON-American, self-elected organization that is now hurting American 
Internet businesses more than anything else.


Fact:
90%+ of SBL/XBL listings NO LONGER contain or disclose an actual ?Spam 
Complaint?.  These listings have become the product of Spamhaus?s 
Nazi-like policing of the internet.  Spamhaus actually spends time 
seeding e-mail opt-in lists of ?THE ROKSO? and many more list owners, 
but there is absolutely NO proof that they actually ever opted-out of 
these seeded lists before tagging a mailing with an SBL. American 
Companies are reacting hastily to SBL listings based on nothing more 
than Spamhaus?s purposefully seeded lists.  In order to support their 
?non-profit? organization, it would make sense that NOT actually opting 
out of a seeded list would be in their best interest.


Fact:
Spamhaus?s disclaimer states the organization?s postings are the result 
of their ?opinion and NOT proven?.  They take ?no responsibility? for 
their listings that may be incorrectly or falsely posted.  This is 
exactly why there should be some form of DUE PROCESS before a listing 
is acted upon by any ISP or Host Company as a lot of damage can be done 
to an innocent Company and their employees before innocence can be 
proven.


Conclusion:
Spamhaus.org started out with good intentions and a fair cause 
especially prior to American legislature being passed.  With time 
however, momentum and too much growing authority, this organization has 
become too powerful and they operate in a 100% Non-American fashion:


* There is No Due Process
* American?s for the First Time ARE Guilty until Proven Innocent
* Spamhaus openly admits: ?We Don?t Support American Legislation?: 


The time has come to put a stop to the unlawful, Nazi-like power and 
authority Spamhaus has developed.  Spamhaus has been ?lucky? to have 
gotten away with the Unjust Pseudo-Law they have managed to develop 
thus far in America, a country that should have IGNORED them a 
long-time ago.


America Is Going To Stop Spamhaus?s Influence Starting Today: Spamhaus 
actually has NO real legal authority in America.  Our government gives 
them no mention and no power to govern our internet.  Spamhaus is 
simply self-empowered by the SBL/XBL listings that feed our ISPs.

It is time to request that our American ISPs STOP acting on Spamhaus 
listings.  We can no longer be punished for listings Spamhaus posts 
with no due process.
